We desire for our customers to have the best experience possible while doing business with us. To help ensure this happens, we have composed the following terms and conditions.

WHAT THESE TERMS AND CONDITIONS COVER

These terms and conditions cover and apply to all transactions between the “Client” (person purchasing the jewelry item(s); also referred to as “you” through these terms and conditions) and Bespoke Fine Jewelry, LLC (also referred to as “we” through these terms and conditions). These terms and conditions superseded and cancel any other oral or written agreement between the aforementioned parties. A client acknowledges and enters into these Agreements upon placing an inquiry or submission that leads to an accepted order as outlined below in the Orders section.

ORDERS

A phone, email, or online inquiry or submission is not considered an accepted order until we have confirmed the order details with you, accepted payment, and provided an estimated ship date. An inquiry or submission is not a recognized and accepted order until all three of the aforementioned items has occurred. We are not responsible for fulfilling any inquiry or submission that has not become an accepted order.

It is at the sole digression of Bespoke Fine Jewelry, LLC if we decide to accept and process an order. Any inquiry or submission that appears to be fraudulent in nature will not be accepted as an order. If requested, it is the client’s responsibility to provide adequate proof of identity and address verification to Bespoke Fine Jewelry, LLC before we accept, process, and ship any order.

SHIPPING

SHIPPING

We include either USPS 1-3 Day or UPS 2nd Day shipping on all orders within the continental United States unless otherwise noted (our finished jewelry typically has different shipping options). We do not ship to post office boxes and any other location that UPS/FedEx will not ship to. If you wish to have a faster shipping method, please contact us.

We offer international shipping to select countries (contact us for more information). International shipments are sent FedEx International Priority with shipping, customs/duties, and taxes at the expense of the client. We may send the shipment COD where the customs/duties and/or taxes are due at delivery of the package and paid to the FedEx agent directly. Shipping times vary depending on country location and length of customs processing.

NOTE: To prevent fraud, we will ONLY ship items to the billing address for the credit card used for payment, no exceptions.

An adult signature will be required for delivery of the package- unless you ask us to waive this security feature. If you waive the signature option, we are not responsible for any lost or stolen packages.

ORDER  PROCESSING AND TRACKING

Once your order has been accepted, we will provide you with an estimated ship date. Upon shipment you will receive an email stating that your item has shipped along with the UPS or FedEx tracking number for the package.

Generally, for non-custom pieces we like to allow two to four weeks for the jewelry to be created, stones set, and piece finished and ready for shipping. Sometimes it is less time. Solitaire rings, for example, typically are ready to ship in 5-7 business days depending on the metal type chosen. Settings with diamonds or gemstones that need to be special ordered will take longer. Additionally, any alterations to a setting will add more time to its expected ship date.

If you need it in a rush, let us know in the comments of your inquiry. Sometimes we can rush the order. Each piece is different, so we will discuss your options once you submit your inquiry.

Note: Platinum settings take a few days longer to complete no matter the style.

For pre-design and custom orders, our standard shipping is UPS 2nd Day which will add another day or two depending on your location (Note: finished jewelry may be different). Overnight Saver and Overnight Priority shipping speeds are optional. (International shipping is extra and timing depends on selected speed/location).

RETURNS

All custom and special order jewelry items are not returnable. If you have a question about if an item is a custom or special order piece, please contact us.

For non-custom and non-special orders, we accept returns or exchanges for an online purchase within 5 days of your purchase date, unless otherwise noted (see below). If 5 days have gone by since your purchase, unfortunately we cannot offer you a refund or exchange. To be eligible for a return, your item must be unused/unworn and in the same condition that you received it. If the item contains a graded diamond(s) or gemstone(s), each certificate and all accompanying materials must be present and in original, unaltered condition to be eligible for return, exchange, or credit. Earrings that appear to have been worn are not returnable for sanitary reasons.

All sale items, engraved items and special order merchandise are considered final sale. Engraved items can not be returned or exchanged unless there is a product defect or engraving error. Merchandise that has been altered or sized may not be returned or exchanged. If the item was marked as a gift when purchased and shipped directly to you, you will receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be emailed to you.

NOTE: Some items, such as our vintage finished jewelry, have a longer return period. The webpage where the jewelry is displayed will describe the return period. This never applies to custom, pre-designed, repairs, or altered items.

HOW TO MAKE A RETURN

Items purchased in person can only be returned or exchanged in person. Items purchased online can be returned or exchanged in person or by mail. You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund. To return your product, contact us for return instruction and address at info@bespokefinejewelry.com. Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

If you are shipping an item over $100, you should consider using a trackable shipping service or purchasing shipping insurance. We can not guarantee that we will receive your returned item, and we are not responsible for any item not received or missing in the shipping container upon receipt.

REFUNDS

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days. Refunds will be credited to the same form of payment in your original purchase. Please allow 30 days for the credit to appear on your billing statement. Please note that your original shipping and handling or other additional costs will not be refunded, unless you received a damaged, defective, or incorrect item.

CUSTOM AND SPECIAL ORDER JEWELRY ITEMS

DEFINITION

Any jewelry item(s) designed and/or created specifically for the client or any jewelry that was modified from its standard design to meet to the client’s specifications. This includes our semi-custom and pre-designed jewelry items where a client has selected specific gemstone type(s) and/or quality(ies) to be set in their selected mounting.

DEPOSIT AND PRODUCT SATISFACTION

In order to begin commissioning the piece, Bespoke Fine Jewelry, LLC requires a deposit equal to 50% of the total sale price rounded to the nearest $10.

For total custom design pieces the client will be shown a CAD rendering or wax model of the item. If the design is satisfactory to the client, the client will be asked to provide written agreement (or an email) to Bespoke Fine Jewelry, LLC stating he/she approve the design. This approval signifies the client’s desire for Bespoke Fine Jewelry, LLC to create the design shown and that the client agrees to pay the agreed upon price for the entire jewelry piece. At the completion of a satisfactory piece, Bespoke Fine Jewelry, LLC will require the remaining balance due before delivery of the product.

Note: A $350 non-refundable deposit is required for all custom and special order pieces. This deposit will go towards the final price of the piece upon design’s approval. A 15% restock fee applies to non-purchased setting examples.

RETURNS

We do not accept returns for custom and special order jewelry items.

OUTSIDE WORK

Bespoke Fine Jewelry, LLC is not responsible for any work performed on a jewelry piece by any other entity other than Bespoke Fine Jewelry, LLC. This includes, but not limited to, ring resizing, rhodium plating, stone tightening, prong re-tipping, and other repairs or modifications. Any item that shows signs of outside work performed on it is not eligible for return, exchange, or any other coverages for damages or defects. It is Bespoke Fine Jewelry, LLC’s sole discretion whether an item has been deemed to have had outside work preformed on it. This is particularly noted when the item has been noticeably altered from the original state order/invoiced state.

SALES TAX

Bespoke Fine Jewelry, LLC only collects sales tax for jewelry items sold in, delivered to, and/or shipped to individuals- you, the client- in the Commonwealth of Pennsylvania. Any item sold in, delivered to, and /or shipped to individuals outside of the Commonwealth of Pennsylvania does not have sales tax collected by Bespoke Fine Jewelry, LLC and the individual purchasing the jewelry item is solely responsible for paying his/her state’s sales/use tax.

DESIGN

Bespoke Fine Jewelry is not liable for any copyrights violated by manufacturing client specific products. All liability and any damages received from the use of copyrighted items is the sole responsibility of the client.

PHOTOGRAPHY AND DESIGN RIGHTS

Bespoke Fine Jewelry, LLC has the right to publish and use as we please any photograph(s) and/or design elements/CAD/CAM of the above listed jewelry item(s). We also retain the right to recreate or reproduce any design that we create for a client without approval from the client.

TOTAL AGREEMENT/TERMS AND CONDITIONS

ENTIRE AGREEMENT

This Agreement, together with all Exhibits annexed hereto: (i) contains all the agreements, representations, warranties and covenants by the parties with respect to the transactions contemplated by this Agreement, (ii) constitutes the entire agreement between the parties, and (iii) shall be deemed to supersede and cancel any other oral or written agreement between the parties hereto relating to the transactions herein contemplated.

SURVIVAL OF WARRANTIES AND REPRESENTATIONS

All representations, warranties, covenants and agreements contained in the Agreement shall survive the Sale without limitation or restriction of any nature whatsoever.

GOVERNING LAW

This Agreement shall be construed and enforced in accordance with and governed by the laws of the Commonwealth of Pennsylvania regardless of where the transaction may have occurred.

RELATIONSHIP OF PARTIES

Nothing contained in this Agreement shall be deemed or construed by the parties hereto or by any third person to create the relationship of principal and agent or of partnership or of joint venture or of any successorship or association between Seller and Buyer, and neither the provisions contained in this Agreement nor any acts of the parties hereto shall be deemed to create any relationship between the Parties other than the relationship of a seller and buyer.
